Provider: Alessandro Graf GmbH
Version: September 2026
1. Scope
1.1. These General Terms and Conditions (hereinafter “Terms”) apply to all contracts concluded between Alessandro Graf GmbH, Forneyweg 10, 3212 Gurmels, Switzerland (hereinafter “Provider”), and the customer (hereinafter “Customer” or “Participant”).
1.2. The offering comprises coaching (online/offline), courses, webinars and digital products (self-study online courses).
1.3. These Terms apply to consumers and businesses worldwide, with a focus on Switzerland, Germany and Austria.
1.4. There are no verbal side agreements. Amendments or additions must be made in writing in accordance with section 14
2. Conclusion of contract
2.1. Booking via the website: The presentation of products on the website does not constitute a legally binding offer. By clicking the order button (e.g. “Buy” or “Order with obligation to pay”), the Customer submits a binding order. The contract is only concluded when the Provider confirms it (usually by email).
2.2. Individual booking: For individual coaching, the contract is concluded when the Customer accepts the offer (in writing or in text form, e.g. by email, WhatsApp or Messenger).
3. Prices and payment terms
3.1. All prices stated on the website and in offers are net prices unless expressly marked otherwise. Statutory VAT is charged and shown in addition where the Provider is liable for VAT and this is required by law.
3.2. Payment in advance applies as a rule. The fee is due immediately upon conclusion of the contract.
3.3. Reservation of performance: The right to take part in coaching sessions or courses, or to access digital content, arises only once payment has been received in full.
3.4. Payment by instalments requires an express written agreement. If the Customer defaults on an instalment, the entire outstanding balance becomes due immediately.
3.5. Travel time, mileage and expenses are invoiced to the Customer in addition to the agreed fee if an on-site appointment or travel has been agreed in advance. They are charged as follows: travel time CHF 220 per hour (billed in 15-minute increments), mileage CHF 0.80 per km (outward and return). Public transport is booked in 1st class, flights in Business Class and hotels in at least the 4-star category. Other expenses (e.g. parking, taxi, meals, accommodation) are charged at cost against receipts. Deviations are possible if agreed in writing.
4. Holding of appointments, cancellation & rescheduling by the Provider
4.1. The Provider is entitled to change the place and time of agreed appointments (coaching, webinars, live courses) for good cause, provided this is reasonable for the Customer.
4.2. Cancellation by the Provider: If an appointment or course cannot take place for good cause on the Provider's side (e.g. illness, technical faults), it is not cancelled without replacement but held at a later date (replacement appointment).
4.3. In this case there is no right to a refund of the participation fee, as long as a replacement appointment is offered. Further claims by the Customer (e.g. reimbursement of travel or hotel costs) are excluded.
5. Cancellation by the Customer & right of return
5.1. Principle: There is generally no right of return. Booked services are binding. A refund of the purchase price is excluded.
5.2. For 1:1 coaching & live appointments: Appointments must be cancelled at least 24 hours before they begin. If an appointment is not cancelled in time, or the Customer does not attend without cancelling, the appointment lapses without replacement and is charged in full.
5.3. Note for consumers from the EU (right of withdrawal): To be able to use digital products and services immediately after purchase with legal certainty, the Customer expressly agrees during the ordering process that:
- for digital content (online courses), the contract is performed immediately and the right of withdrawal therefore expires.
- for services (coaching), the Provider begins performance before the withdrawal period ends and the right of withdrawal expires once the service has been performed in full.
Without this consent, access to content can only be granted after the 14-day statutory withdrawal period has expired.
6. Conduct & exclusion of participants
6.1. Respectful conduct is expected in group programmes and webinars.
6.2. The Provider reserves the right to exclude from further participation any participants who persistently disrupt proceedings, make insulting remarks or harm the group dynamic.
6.3. In the event of such an exclusion, there is no right to a refund of the (pro rata) fees.
7. Copyright and rights of use
7.1. All concepts, materials, videos, audio recordings and course content are the intellectual property of Alessandro Graf.
7.2. The Customer receives a simple, non-transferable right of use for personal purposes.
7.3. Any disclosure to third parties, reproduction, publication or commercial use is strictly prohibited.
7.4. Participants may not record live calls or coaching sessions (audio/video).
8. Confidentiality
8.1. Both parties undertake to treat all information received in the course of their collaboration as confidential and not to make it available to third parties.
8.2. In addition, the Provider undertakes to maintain silence about all private and business matters of the Customer that become known in the course of the collaboration.
8.3. The Customer undertakes to treat confidential information about other participants learned in group coaching as strictly confidential and not to pass it on to third parties.

10.4. Liability: The Provider's liability for damage arising from the collaboration is excluded to the extent permitted by law. The Provider is liable only for damage caused by intentional or grossly negligent conduct. Liability for slight negligence and for indirect or consequential damage is excluded to the extent permitted by law. No liability is accepted for damage caused by participants performing exercises improperly.
11. Technical requirements
The Customer is responsible for meeting the requirements for taking part in online offerings (stable internet connection, working hardware). Technical problems on the Customer's side do not entitle them to a repeat session or a refund.
12. Force majeure
The parties are not liable for events of force majeure (e.g. pandemic, natural disasters, war, government measures or other unforeseeable events for which the parties are not responsible). The corresponding obligations are suspended for the duration of the event. If the event lasts longer than 60 days, both parties are entitled to terminate the contract extraordinarily, without either party being able to claim damages from the other.
13. References and recommendations
13.1. After a project has been successfully completed, the Provider is entitled to use testimonials and written references from the Customer for marketing purposes.
13.2. Any use of testimonials, written references or other statements by the Customer requires the Customer's express written approval before each publication. Without this approval, nothing is published.
13.3. Naming the Customer as a reference – including name, company, position or logo – is permitted only after prior consultation and with the Customer's express written consent.
13.4. The Provider undertakes to reproduce testimonials and references accurately, completely and in the agreed context.
14. Amendments and additions
Amendments and additions to these Terms and to individual contracts must be made in writing and are only valid if both parties confirm them in writing. Transmission by email satisfies the written form requirement within the meaning of this clause.
15. Final provisions
15.1. Swiss law applies exclusively.
15.2. The place of jurisdiction is the registered office of the company (Fribourg/Gurmels), unless mandatory statutory provisions provide otherwise.
15.3. Severability clause: Should individual provisions of these Terms be or become invalid, this does not affect the validity of the remaining provisions. The invalid provision is replaced by a valid one that comes closest to the economic purpose of the original provision.
